St. Charles Community (SCC) Confirms New High School Fee to School System

The school system and SCC negotiated an agreement last year for SCC to pay $1,000,000 as a fee in-lieu of providing a graded high school site per early county government Adequate Public Facilities requirements (Docket 90). The fee will be paid to county government in three installments and placed in the new high school construction project line item as follows: $250,000 on or before June 30, 2010; $250,000 on or before September 30, 2010; and $500,000 on or before December 31, 2010.

Is the money earmarked? If so, for what? Has SCC paid the first installment?

And if it has not...or does not...one expects there are monetary penalties for SCC. Yes?

Originally SCC was going to do the grading of the land for the new high school. Now, instead, they are paying the estimated cost to Charles County Government and it will become part of the CIP (Capital Improvement Plan). The construction company hired to do the project will now do the grading as part of their contract. That money goes straight to Charles County Government. The county has confirmed they have received the first installment.

My pending question to staff, which I'm sure will probably be your question is... do we (the school system) then get reimbursed that amount to pay the contractor or does the government pay the contractor directly for the grading or is that just all part of how much money the county is giving us (the school system) and they (county) get to pocket it?
I will keep you posted on the response I receive.

Okay, Part II...We (CCPS) pay the contractor, and submit to the county for reimbursement.
